OVERVIEW

This website is operated by Maloney & Krumm LLC, doing business as Maloney & Krumm. Throughout this website, the terms “we,” “us,” and “our” refer to Maloney & Krumm.

Maloney & Krumm offers this website, including all information, tools, products, and services available through it, to you conditioned upon your acceptance of these Terms of Service.

By visiting our website, creating an account, or purchasing from us, you agree to these Terms of Service and the policies referenced within them. If you do not agree, you should not use our website or purchase our products.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products and services.

  1. ELIGIBILITY AND ACCOUNTS

By using this website, you confirm that you are at least the age of majority in your state of residence or have permission from a parent or legal guardian.

You agree to provide current, complete, and accurate account, billing, payment, and shipping information.

You are responsible for protecting your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

  1. PRODUCTS AND HANDCRAFTED VARIATIONS

Maloney & Krumm may sell candles, soaps, personal-care products, fragrances, room sprays, reed diffusers, car diffusers, home-fragrance products, gifts, accessories, and other merchandise.

We make every reasonable effort to accurately display and describe our products. However, colors and appearances may vary depending on your device and screen settings.

Many of our products are handmade or produced in small batches. Minor variations in color, texture, fragrance, wax appearance, finish, fill level, or packaging may occur and are not necessarily defects.

Product descriptions, prices, packaging, availability, and product selections may be changed without notice. We reserve the right to discontinue products or limit quantities at any time.

  1. PRODUCT USE AND SAFETY

Customers are responsible for reading and following all instructions, warnings, ingredient information, and safety directions supplied with a product.

Candles must never be left burning unattended. Keep burning candles away from children, pets, drafts, flammable materials, and heat-sensitive surfaces. Follow the recommended wick-trimming and burn-time instructions.

Our candles may use LX-series cotton wicks selected and tested to work with our coconut-apricot wax and provide an effective fragrance throw and balanced burn. A small mushroom-shaped carbon formation may develop at the end of an LX wick. This is a normal wick characteristic and is not, by itself, a product defect. Customers should extinguish the candle, allow it to cool, and trim the wick to approximately 1/4 inch before relighting.

Discontinue candle use if you observe an unusually high flame, excessive smoke or soot, a significantly displaced wick, or damage to the vessel.

Soap, personal-care, and fragrance products must be used only as directed. Review the listed ingredients before use. Customers with allergies, sensitivities, or medical concerns should consult an appropriate healthcare professional before using a product. Unless specifically stated otherwise, our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  1. ORDERS

Placing an order constitutes an offer to purchase. An order is not accepted until payment has been authorized and we have confirmed acceptance.

Customer-requested cancellations must be submitted within one hour of placing the order. We will not begin processing an order until this one-hour cancellation window has ended. After the one-hour period, the order becomes final and cannot be canceled.

The one-hour limitation does not prevent Maloney & Krumm from canceling an order because of suspected fraud, payment problems, inventory errors, incorrect pricing, shipping restrictions, product unavailability, or another legitimate business reason. If we cancel an order after payment has been collected, the appropriate refund will be issued.

Please review your products, quantities, fragrance selections, sizes, billing information, and shipping address carefully before submitting your order.

We may limit or refuse orders that appear to be fraudulent, unauthorized, intended for prohibited resale, or placed in violation of these Terms.

All returns, exchanges, damage claims, and refunds are governed by our Return and Refund Policy:

  1. PRICES, BILLING, AND TAXES

Prices, discounts, and promotions may change without notice. The price charged will be the price shown when the order is placed, subject to correction of genuine errors.

Unless expressly stated otherwise, displayed prices do not include applicable sales tax, shipping charges, customs charges, duties, or other fees.

You confirm that you are authorized to use the payment method submitted and agree to pay all charges associated with your order.

Prices offered online may differ from prices offered at markets, events, physical locations, or through third-party selling platforms.

  1. SHIPPING AND DELIVERY

Orders are shipped according to our Shipping Policy:

During periods of extreme heat, particularly during Arizona summers, we generally ship temperature-sensitive products Monday through Wednesday only. Orders completed after Wednesday may be held until the following Monday to reduce the possibility of packages remaining in carrier facilities over a weekend.

Delivery dates and transit times are estimates and are not guaranteed. We are not responsible for carrier delays, severe weather, natural disasters, incorrect customer addresses, customs processing, or other circumstances outside our reasonable control.

Customers are responsible for monitoring tracking information and promptly retrieving packages after delivery. Candles, soaps, fragrances, and other temperature-sensitive products should not be left outdoors, inside mailboxes, in vehicles, in direct sunlight, or in other hot locations.

Damage, breakage, leakage, or melting must be reported within 24 hours of the carrier’s confirmed delivery time and must include clear photographs of the product, packaging, and shipping container. Claims are reviewed according to our Return and Refund Policy.

To the extent permitted by law, Maloney & Krumm is not responsible for heat damage, melting, theft, loss, or deterioration occurring after confirmed delivery when a package is left outdoors, in a mailbox, in a vehicle, in direct sunlight, or in another unsafe location.

  1. RETURNS AND EXCHANGES

Eligibility for returns, exchanges, replacements, or refunds is determined exclusively under our Return and Refund Policy.

Returned products must satisfy the applicable condition requirements for their product category. For health, safety, and hygiene reasons, certain opened, used, burned, sprayed, diffused, or otherwise altered products may not be eligible for return.

  1. INTELLECTUAL PROPERTY

The Maloney & Krumm name, logo, product names, scent stories, photographs, graphics, written content, designs, packaging, and other original materials are owned by or licensed to Maloney & Krumm and are protected by applicable intellectual-property laws.

You may use our website for personal, noncommercial shopping purposes only. You may not reproduce, copy, publish, distribute, modify, sell, or commercially exploit our content without prior written permission.

Shopify’s name, trademarks, and technology remain the property of Shopify and its licensors.

  1. OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, payment services, applications, links, or content supplied by third parties. These services may be governed by separate terms and privacy policies.

We do not control and are not responsible for the content, security, availability, accuracy, or practices of independent third-party websites or services. You use third-party services at your own discretion and should review their applicable policies.

  1. RELATIONSHIP WITH SHOPIFY

Maloney & Krumm is powered by Shopify, which provides the ecommerce platform used to operate this store. Purchases made through this store are transactions directly between the customer and Maloney & Krumm.

To the extent permitted by law, Shopify is not responsible for products sold by Maloney & Krumm or for any injury, loss, damage, refund, dispute, or other claim arising from a transaction with Maloney & Krumm.

Because Shopify hosts our store, Shopify and its service providers may process information necessary to operate the website, complete transactions, prevent fraud, and provide related services.

We reserve the right to correct errors, update information, or cancel affected orders. If we cancel an order after collecting payment, we will issue the appropriate refund.

To the fullest extent permitted by applicable law, Maloney & Krumm, Shopify, and their respective owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of this website or products purchased through it.

This limitation does not apply when liability cannot legally be excluded or limited, including any rights provided under applicable consumer-protection law.

We may assign our rights and obligations as part of a sale, transfer, restructuring, or other lawful business transaction.

These Terms and transactions with Maloney & Krumm are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where another jurisdiction’s consumer-protection laws must legally apply.

To the extent permitted by law, disputes shall be handled in the appropriate state or federal courts located in Maricopa County, Arizona.
